DRINKIES LOYALTY PROGRAM

The Drinkies Loyalty Program (“Program”) is applicable for users of the Drinkies mobile phone app (“Drinkies App”) only, and offers 4 membership tiers as follows: “Bronze”, “Silver”, “Gold” and “Platinum". By participating in this Program, you confirm that you have read, understood and agreed to the Program terms and conditions (“Program Terms and Conditions”) below, the Terms of Use of Drinkies (https://www.drinkies.sg/terms-and-conditions), and the Privacy Notice of Drinkies (https://www.apbsingapore.com.sg/privacy-policy/), which constitute a binding agreement between you and Drinkies under applicable law.

1. Membership

1. User profiles are tier-based memberships and include the following statuses: “Bronze”, “Silver”, “Gold” or “Platinum”. The names of such tiers may be amended by Drinkies at its sole and absolute discretion. When you sign up for an account with Drinkies on the Drinkies App, you will automatically join the Program, starting at the “Bronze” tier. To upgrade to the next tier, you need to achieve the minimum spend corresponding to such tier (as elaborated below). You can accumulate the requisite minimum spend by making purchases on the Drinkies App. Minimum spend amount is calculated using the sub-total amount, excluding taxes and fees.
   

2. Only one (1) user Program membership is available for each registered individual aged 18 years old or above with a valid Drinkies account and a valid mobile phone number. Each user warrants that any information provided pursuant to this Program (including without limitation mobile number) is true, accurate, valid and to be relied upon by Drinkies. Each user shall be responsible for keeping Drinkies informed of any update to the information initially provided, as necessary.

3. For clarity, only persons aged 18 years old and above are eligible to purchase liquor (including purchasing on the Drinkies App). It is an offence in Singapore for individuals below 18 years old to purchase liquor; the offence upon conviction (by relevant authorities) is punishable with a fine not exceeding S$10,000.

4. Program Membership Tiering:

   Bronze Member:
   Cumulative minimum spend of less than S$600 on the Drinkies App within one hundred and twenty (120) days period
   

   Silver Member:
   Cumulative minimum spend of at least S$600 on the Drinkies App within one hundred and twenty (120) days period
   
   Gold Member:
   Cumulative minimum spend of at least S$1,200 on the Drinkies App within one hundred and twenty (120) days period
   
   Platinum Member:
   Cumulative minimum spend of at least S$1,800 on the Drinkies App within one hundred and twenty (120) days period
   

   The validity period for the “Silver”, “Gold”, and “Platinum” membership tiers is one hundred and twenty (120) days ("Membership Period"). When you achieve the cumulative minimum spend for each tier, you will be automatically upgraded to the corresponding tier, and a new Membership Period will start. You will need to achieve at least the minimum spend of such tier during the corresponding Membership Period to requalify for the same tier in the next Membership Period.
   
   Illustrative examples:
   If you are currently a Silver Member, and if you accumulate spend of S$600 - S$1,199.99 on the Drinkies App within the current Membership Period, you will requalify for Silver Member in the next Membership Period. If you do not accumulate a minimum spend of at least S$600 on the Drinkies App within the current Membership Period, your membership tier status will be revised to become a Bronze Member in the next Membership Period.
   
   If you accumulate spend of S$1,200 - S$1,799.99 on the Drinkies App within the current Membership Period, your membership tier status will be upgraded to become a Gold Member automatically (upon achieving such spend) and a new Membership Period begins.
   
   If you accumulate spend of S$1,800 or more on the Drinkies App within the current Membership Period, your membership tier status will be upgraded to become a Platinum Member automatically (upon achieving such spend) and a new Membership Period begins.

   If while you are a Platinum Member, you do not accumulate a minimum spend of at least S$1,800 on the Drinkies App within the current Membership Period, your membership tier status will be revised to become a Gold Member in the next Membership Period.

2. Drinkies Coins (hereafter called “coins”)

1. You will earn coins for every S$1 spent on the Drinkies App based on the corresponding membership tier status that you are in. The coins earn rates are set out below.

2. Coins are non-transferrable to other users.

3. Coins can only be used for items in the Rewards section.

4. Coins can only be earned for in-app purchases on the Drinkies App.

5. Coins are only assigned to completed orders on the Drinkies App that have been delivered.

6. Coins have no cash or monetary value and shall not be exchangeable for cash, currency or credit in any form.

7. Coins are accumulated over the net purchase value of the order (the amount that you pay).

8. Coins will expire twelve (12) months after such coins were earned.

9. Illustrative example: if you make an in-app purchase on 19 March 2024 and earn 100 coins, the expiry date for such 100 coins is 19 March 2025. If you make another in-app purchase one month later on 19 April 2024 and earn 50 coins, the expiry date of such 50 coins is 19 April 2025 (and the expiry date for the earlier-earned 100 coins remain unchanged at 19 March 2025).

10. Drinkies determines, in its sole and absolute discretion, the quantity of coins required for an exchange for rewards. The exchange rate may change from time to time in Drinkies’ sole and absolute discretion and as may be published in the Drinkies App. You shall not be entitled to request from Drinkies any explanation pertaining to the calculation methods (for crediting the coins) or other matters relating to the coins or rewards for any purposes whatsoever.

11. Coins Earn Rates
    
    When you make purchases of StarBar electronic vouchers (“StarBar Voucher Purchases”) on the Drinkies App, the coins earn rate for each membership tier is set out below:
    
    Bronze Member: Earn 5 coins per S$1 spent
    
    Silver Member: Earn 10 coins per S$1 spent
    
    Gold Member: Earn 15 coins per S$1 spent
    
    Platinum Member: Earn 20 coins per S$1 spent
    
    
    When you make purchases of draught beer kegs and Guinness MicroDraught on the Drinkies App, the coins earn rate for each membership tier is set out below:
    Coins Multiplier for Draught Beer Keg and Guinness MicroDraught Purchases: There is a 4x coins multiplier for all draught beer kegs and Guinness MicroDraught purchases where users will be awarded four times the amount of coins per S$1 spent based on their corresponding membership tier:
    
    Bronze Member: Earn 20 coins per S$1 spent
    
    Silver Member: Earn 40 coins per S$1 spent
    
    Gold Member: Earn 60 coins per S$1 spent
    
    Platinum Member: Earn 80 coins per S$1 spent
    

3. Rewards

1. Rewards (in the Rewards section, and subject to stock availability) can only be redeemed using the coins. For clarity, expired coins are void and cannot be used for any redemption of any rewards.
   

2. Rewards cannot be used in combination with other promotional codes.
   

3. Redemption ends on the indicated date and time stated in the reward.

4. All rewards, regardless of their condition, quality, merchantability or fitness for use, are not exchangeable for cash, currency or credit in any form. All non-Drinkies branded rewards are subject to the issuing or coordinating organizations’ terms and conditions as applicable.
   

4. Exclusions:

1. The coins (refer to Section 2 above) and rewards (refer to Section 3 above) are not available for the following transactions:
   a. Purchases made with other promotional codes;
   b. Taxes, delivery, and service charges; and
   c. other transactions which may be excluded from time to time in Drinkies’ sole and absolute discretion.

5. Cancellation and refunds

1. Coins (refer to Section 2 above)
   Coins are deducted from your account after you have used the coins to redeem for the purchase of a reward. Coins are only refundable in case a reward is not available at the moment of purchase. In all other cases, coins are non-refundable.

2. Rewards (refer to Section 3 above)
   Rewards are non-refundable. When a reward is not available at the moment of purchase, its value in coins will be returned to your account.

3. Drinkies may at its sole and absolute discretion and without prior notice to you, reject your request to redeem coins or rewards for any reason whatsoever, including without limitation, where:
   ◦ there are insufficient coins or rewards for redemption;
   ◦ the coins or rewards you wish to use for redemption have been issued to you erroneously; or
   ◦ the reward is no longer made available or out-of-stock;
   ◦ Drinkies has reasons to believe or suspect that the redemption transaction may be suspicious, illegal, involves any criminal activity or involves coins or rewards that have been obtained or procured through dishonest or fraudulent means or abusive behavior.

4. The users shall not in any circumstances whatsoever be entitled to any refund of monies or any form of compensation (to the maximum extent permitted under law) in respect of the Program.

6. The coins and rewards must be used and/or redeemed within their applicable validity period. There shall be no extension of time for the validity period of any unused coins or rewards for any reason whatsoever. You agree that you shall have no claim whatsoever against Drinkies (to the maximum extent permitted under law) for any expired coins or rewards. Drinkies accepts no responsibility (to the maximum extent permitted under law) for errors in the crediting of coins or rewards, other than those in relation to errors resulting from Drinkies’ own gross negligence.

7. Drinkies reserves the right (at its sole and absolute discretion, to the maximum extent permitted under law) to cancel or modify orders, or revoke the use of rewards, where the rewards are used in the following circumstances: suspicious or fraudulent reward use, rewards abuse, including reward redeemed using multiple accounts or multiple checkouts associated with the same customer or a group of customers; and/or reward used in bad faith (including resold reward, or use of rewards on orders made and intended for resale).

8. Drinkies reserves the right at any time and in its sole and absolute discretion to vary the Program Terms and Conditions (or any part thereof) and/or to withdraw or terminate the Program without prior notice or reason. The users’ continued participation in the Program shall be deemed to be the users’ agreement to such varied Program Terms and Conditions.

9. All decisions made by Drinkies in relation to the Program, the Program Terms and Conditions and any aspect thereof (including without limitation Drinkies’ right to remove any user from participation in the Program) are final and binding and no correspondence will be entertained.

10. Drinkies accepts no responsibility and will not be liable (to the maximum extent permitted under law) for any loss, injury, expense, delay or irregularity (“Loss”) arising out of or in connection with the Program, including without limitation any Loss (whether suffered by the users, their families or third parties) arising from or in connection with or as a result of any third parties’ provision of goods and/or services, and/or the possession and/or use of coins and/or rewards.

11. These Program Terms and Conditions shall be governed by Singapore law and the parties agree to submit to the jurisdiction of the courts of Singapore.

12. The Contracts (Rights of Third Parties) Act 2001 is hereby expressly excluded from application to these Program Terms and Conditions.
